Welcome to JM Press.
These Terms of Service ("Terms") govern your access to and use of the JM Press website, online store, products, content, features, tools, and related services (collectively, the "Services").
The terms "JM Press," "we," "us," and "our" refer to JM Press LLC, the business operating this website and store.
Our store is powered by Shopify, which provides the ecommerce platform that allows us to sell our products and provide our Services.
By accessing, browsing, purchasing from, or otherwise using our Services, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our Services.
1. Eligibility and Use of Our Services
You must be legally capable of entering into a binding agreement under the laws applicable to you in order to use our Services or make a purchase.
You agree to provide accurate, current, and complete information when placing an order, creating an account, or otherwise interacting with our Services.
You are responsible for maintaining the security of your account information and for all activity associated with your account.
You may not use our Services for any unlawful, fraudulent, abusive, or unauthorized purpose.
2. Our Products
JM Press offers a variety of products designed to help with planning, organization, tracking, writing, budgeting, productivity, and everyday life.
Our products may include, depending on the product:
- Digital planners;
- Interactive PDFs;
- Fillable PDFs;
- Printable products;
- Google Sheets templates and systems;
- Trackers and calculators;
- Workbooks;
- Digital journals;
- Digital notebooks;
- Pocket diaries and other writing products; and
- Other digital or physical products introduced from time to time.
Because our products vary, the individual product page is the most accurate source of information about what is included with a particular purchase.
Product descriptions, images, demonstrations, screenshots, videos, specifications, compatibility information, and other product details are provided to help you understand what you are purchasing.
We make reasonable efforts to ensure that product descriptions and images are accurate. However, colors and appearance may vary depending on your device, screen, software, printer, or other settings.
We reserve the right to modify, update, discontinue, or replace products at any time.
3. Digital Products
Many JM Press products are delivered digitally.
Digital products may include downloadable files, templates, PDFs, Google Sheets, or other electronically delivered materials.
Where applicable, your purchase may include access to instructions, guides, tutorials, or other supporting materials.
The specific format, included files, device compatibility, software requirements, and instructions for a product will be stated on the applicable product page.
You are responsible for having the appropriate device, software, internet connection, and compatible applications required to access and use your purchase.
For example, Google Sheets products require access to Google Sheets and may have features that work best on a laptop or desktop computer.
4. Product Access and Delivery
Digital products are generally delivered electronically after successful payment through the delivery method stated at checkout or in your order confirmation.
You are responsible for providing an accurate email address and other information necessary to receive your purchase.
If you do not receive your digital purchase, please check your spam, junk, and promotions folders before contacting us.
If you continue to experience an access or delivery problem, contact us and we will make reasonable efforts to help you access the product you purchased.
We do not guarantee uninterrupted availability of any digital product, website, third-party application, or platform.
5. Google Sheets and Third-Party Platforms
Some JM Press products use third-party platforms, including Google Sheets.
When you purchase a JM Press product that uses a third-party platform, your use of that platform is also subject to the platform's own terms and policies.
JM Press does not control third-party platforms and cannot guarantee their continued availability, functionality, compatibility, or future features.
If Google, Shopify, or another third-party provider changes, limits, suspends, or discontinues a feature that affects a JM Press product, we will make reasonable efforts to assist where possible, but we cannot guarantee that third-party functionality will remain unchanged indefinitely.
6. Tutorials, Guides and Support
Some JM Press products include tutorials, user guides, instructions, or other educational materials.
These materials are intended to help you understand how to use the product.
We do not guarantee that every product will include a tutorial or guide. The product listing will indicate where additional instructions or tutorials are included.
Customer support is available for reasonable questions relating to accessing and using your purchased JM Press product.
7. Orders and Acceptance
When you place an order, you are submitting a request to purchase the selected product or products.
Your order is subject to acceptance by JM Press.
We reserve the right to refuse, cancel, or limit an order where reasonably necessary, including in circumstances involving:
- suspected fraud or unauthorized activity;
- pricing or listing errors;
- technical errors;
- duplicate or accidental orders;
- misuse of promotions;
- violation of these Terms; or
- circumstances where we are unable to fulfill the order.
- If we cancel an order after payment has been received, we will provide an appropriate refund where required.
8. Prices, Taxes and Payments
Product prices are displayed on our website and may vary by currency, market, location, applicable taxes, promotions, or other factors.
Prices may change at any time, but changes will not affect an order that has already been accepted except where required by law or where an obvious pricing or technical error occurred.
Applicable taxes, including VAT or other transaction-based taxes, may be calculated and added at checkout or included in the displayed price depending on the customer's location, applicable law, and our tax settings.
You are responsible for providing accurate billing and payment information.
Payments are processed through Shopify and/or third-party payment providers.
JM Press does not generally receive or store your complete payment-card information.
9. Promotions and Discounts
From time to time, JM Press may offer discounts, promotional codes, sales, or special offers.
Promotions may have their own terms, eligibility requirements, expiration dates, or product exclusions.
Unless expressly stated otherwise:
- promotions cannot be combined;
- promotional offers have no cash value;
- expired promotional codes cannot be honored; and
- JM Press may correct or cancel a promotion affected by an obvious technical or pricing error.
10. Returns, Refunds and Cancellations
Digital products
Due to the nature of digital products, digital purchases are generally final sale and are not eligible for return or refund once the product has been delivered or access has been provided.
Digital products cannot be physically returned.
However, if you experience a genuine technical problem, file-access issue, corrupted file, or another issue preventing you from receiving or accessing a product you purchased, please contact us so that we can investigate and, where appropriate, provide a replacement file, corrected access, or other reasonable solution.
Physical products
If JM Press offers physical products, any applicable return, refund, exchange, or cancellation terms will be stated in our Refund and Returns Policy and/or on the applicable product page.
Consumer rights
Nothing in these Terms is intended to remove or restrict any consumer rights that cannot legally be excluded or limited under applicable law.
11. Intellectual Property
All JM Press content and materials, including but not limited to:
- product designs;
- planners;
- journals;
- workbooks;
- templates;
- Google Sheets systems;
- formulas;
- graphics;
- illustrations;
- text;
- photographs;
- videos;
- logos;
- trademarks;
- branding;
- website content; and
- other original materials
- are owned by or licensed to JM Press and are protected by applicable intellectual-property laws.
Purchasing a JM Press product gives you a limited, non-exclusive, non-transferable license to use that product for your own permitted use.
Unless expressly stated otherwise, your purchase does not transfer ownership of the underlying intellectual property to you.
12. Personal Use and Prohibited Distribution
Unless a product specifically states otherwise, JM Press products are licensed for personal use only.
You may not:
- resell a JM Press product;
- redistribute or share purchased files;
- upload purchased files to public websites or file-sharing platforms;
- give copies of purchased files to others;
- reproduce products for distribution;
- claim JM Press products as your own work;
- remove copyright or ownership notices;
- modify a JM Press product for resale or redistribution;
- use our products to create competing products for sale; or
- use our products in any other manner that infringes JM Press's intellectual-property rights.
Purchasing a product does not give you permission to distribute the underlying files or make them available to others.
13. Website Content
We make reasonable efforts to provide accurate and useful information through our Services.
However, website content may occasionally contain errors, omissions, outdated information, or technical inaccuracies.
We reserve the right to correct errors and update information at any time.
Information provided through our website is for general informational purposes and should not be treated as professional financial, legal, medical, tax, or other specialized advice unless expressly stated otherwise.
14. Planners, Trackers and Organizational Tools
JM Press planners, trackers, templates, and organizational systems are designed to assist with planning and organization.
They are tools, not guarantees of financial, professional, personal, health, business, or other outcomes.
For example, a budgeting or expense-tracking product does not constitute financial advice, and a planning tool does not guarantee that a particular goal or result will be achieved.
You remain responsible for decisions made using our products.
15. Third-Party Services and Links
Our Services may use or link to third-party services, applications, websites, or tools.
These may include services used for:
- payments;
- ecommerce;
- digital delivery;
- Google Sheets;
- analytics;
- advertising;
- email;
- social media; and
- other business functions.
Third-party services operate under their own terms, privacy policies, and practices.
JM Press does not control third-party services and is not responsible for their availability, security, content, policies, or practices.
16. Shopify
Our store is powered by Shopify.
Shopify provides the ecommerce infrastructure through which we operate our store, including certain checkout, payment, security, analytics, and related functionality.
Your purchase is made from JM Press, not from Shopify.
Your use of Shopify-related functionality may also be subject to Shopify's applicable terms and policies.
17. Disclaimer of Warranties
To the fullest extent permitted by applicable law, our Services and products are provided on an "as available" and "as is" basis.
We do not guarantee that:
- our website will always be available;
- our Services will always operate without interruption;
- digital files will work with every device, application, or operating system;
- third-party platforms will remain available or unchanged;
- our Services will be completely error-free; or
- use of our products will produce any particular result.
However, nothing in these Terms excludes any warranty, guarantee, or consumer right that cannot legally be excluded under applicable law.
18. Limitation of Liability
To the fullest extent permitted by applicable law, JM Press and its owners, officers, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our Services or products.
This may include loss of profits, revenue, business opportunities, data, or other intangible losses.
Nothing in these Terms limits liability where such limitation is prohibited by law, including liability that cannot legally be excluded or limited under applicable consumer-protection or other laws.
19. Indemnification
To the extent permitted by applicable law, you agree to be responsible for losses or claims arising from your unlawful use of the Services, your violation of these Terms, or your infringement of the rights of JM Press or another person.
This section does not require you to indemnify JM Press for matters caused by JM Press's own unlawful conduct or where such indemnification would not be permitted by applicable law.
20. Suspension and Termination
We may suspend or terminate your access to our Services where reasonably necessary, including if you:
- violate these Terms;
- engage in fraudulent or abusive activity;
- misuse our products or intellectual property;
- interfere with the operation or security of our website; or
- engage in unlawful activity.
